लाइसेंस राज की याद

गत सोमवार को केंद्र सरकार ने एक ऐसी घोषणा की जो देश में नियामकीय स्वायत्तता को एक और झटका है। सरकार ने यह घोषणा की कि सरकारी थिंक टैंक नीति (नैशनल इंस्टीट्यूट फॉर ट्रांसफॉर्मिंग इंडिया) आयोग की एक समिति उन दवाओं के बारे में 'अनुशंसा' करेगी जिन्हें सरकार की मूल्य नियंत्रण नीति के तहत खरीदा जाएगा। इस समिति में अनिवार्य तौर पर वरिष्ठï अफसरशाह शामिल होंगे। फिलहाल यह जिम्मेदारी राष्ट्रीय औषधि मूल्य प्राधिकार अर्थात एनपीपीए के पास थी। एनपीपीए न केवल अनिवार्य दवाओं की राष्ट्रीय सूची (एनएलईएम) में मौजूद औषधियों की कीमतों का निर्धारण करता है बल्कि स्टेंट जैसे अन्य स्वास्थ्य उपकरणों का भी। अभी हाल ही में स्टेंट की कीमतों पर नियंत्रण किया गया। सरकार ने अपनी निर्धनोन्मुखी नीति के तहत ऐसा किया है। किन दवाओं को अनिवार्य औषधि घोषित किया जाए और एनएलईएम के दायरे में लाया जाए और यह काम कैसे किया जाए इसके तौर तरीकों में भी बदलाव लाया गया है। एनएलईएम के दायरे में आने के बाद औषधियां स्वत: मूल्य नियंत्रण के दायरे में आ जाती हैं। अब नीति आयोग की समिति के पास यह अधिकार होगा कि वह यह तय करे कि कौन सी दवाओं का मूल्य नियंत्रित किया जाएगा। अन्य औषधियों की कीमत निर्धारित करने का अधिकार भी एनपीपीए से छीन लिया गया है और उसे भी नीति आयोग के अधीन गठित समिति को सौंप दिया गया है।यहां दो मूलभूत बातें ऐसी हैं जिनका उल्लेख करना आवश्यक है। पहली बात, मूल्य नियंत्रण और औषधियों के नियमन की मौजूदा व्यवस्था में काफी गड़बडिय़ां हैं। इसमें चिकित्सकों, मरीजों, अस्पतालों और दवा निर्माताओं के प्रोत्साहन के पूरे तंत्र को ध्यान में नहीं रखा जाता है। उदाहरण के लिए स्टेंट की कीमत को नियंत्रित करने से शायद स्टेंट का ऑपरेशन कराने वाले मरीजों द्वारा कुल चुकाई जाने वाली राशि में कोई खास अंतर नहीं आया हो। ऐसा इसलिए क्योंकि अस्पताल आसानी से इस लागत को अन्य मदों में स्थानांतरित कर सकते हैं। इस प्रक्रिया में सबसे अच्छी गुणवत्ता वाले स्टेंट भी इस्तेमाल नहीं किए जाते। ऐसे में यह बात साफ है कि नियामकीय ढांचा बनाते समय समुचित तरीके से विचार नहीं किया गया। यहां तक कि जो दवाएं अनिवार्य नहीं हैं उनकी भी मूल्य सीमा होनी चाहिए या फिर उनकी कीमतों में सालाना 10 फीसदी से अधिक इजाफा नहीं होना चाहिए, ऐसा नियम भी काफी हद तक बेतुका प्रतीत होता है। एनएलईएम के गठन के बाद की अवधि में और 2013 में औषधि मूल्य नियंत्रण की व्यवस्था लागू होने के बाद एनपीपीए ने भी कई अवसरों पर दायरे का अतिक्रमण किया। अदालतों ने उसे नियंत्रण में किया।

इस प्रकृति की प्रतिबंधात्मक नियामकीय नीतियों के कारण अक्सर अधिक से अधिक मनमाने नियंत्रण की मांग उठने लगती है। यहां दूसरी प्रासंगिक बात यह है कि नियमों के अधीन काम करने वाले नियामकों की जगह नौकरशाहों का नियंत्रण कायम करना कतई अच्छी बात नहीं है। इतना ही नहीं उन्हें यह अधिकार देना तो और खतरनाक है कि कौन सी दवा किस कीमत पर बिकेगी। ऐसी व्यवस्था अक्सर लॉबीइंग को जन्म देती है। भले ही तात्कालिक इरादा ऐसा नहीं हो। स्वतंत्र नियामक जो पारदर्शी निर्णय लेते हैं, वे ही ऐसा मनमानापन रोक सकते हैं। दुर्भाग्यवश जिन अफसरशाहों को मौजूदा सरकार ने यह अवसर दिया है, उनका इन बातों में वैसा यकीन नहीं है जैसा कि स्वतंत्र नियामकों का है। ऐसे में कई स्वतंत्र निकायों से आजादी से काम करने का अधिकार ही छिन गया है। एनपीपीए इस सूची में सबसे नया है। हम कह सकते हैं कि लाइसेंस राज के सबक भुला दिए गए हैं।

Shot in the arm: on SC upholding Insolvency and Bankruptcy Code

Last week’s Supreme Court judgment upholding the validity of the Insolvency and Bankruptcy Code 2016 (IBC) in its “entirety” could have a major impact on the country’s economic landscape. The fledgling(Starter) IBC has been severely tested in the two years since its enactment(कानून), with the Centre being forced to amend a couple of its provisions in order to plug some loopholes that enabled defaulting borrowers to challenge the legislation. Any law of this nature that takes over businesses and assets from defaulters and empowers lenders to change the management is bound to face legal challenges. Borrowers were never going to take the IBC lying down, and that is exactly what happened; over the last two years, they have challenged various aspects of the law in tribunals and courts. In the event, the apex court’s stamp of approval on the entire Code is a strong signal to borrowers and banks even as it brings a sense of relief to the Centre, which has been watching one of its better economic initiatives being stifled(curb) by vested interests.

One of the major challenges mounted(rises) against the IBC was by operational creditors, who are owed money by the company in the normal course of operations for supply of goods and services. In the payment waterfall prescribed under Section 53 of the IBC in the event of liquidation of the company or its sale to another entity, their dues rank below those of financial creditors, workmen and employees. This was challenged by the operational creditors, who wanted equal treatment with financial creditors in the waterfall mechanism. Several landmark cases that were referred to the National Company Law Tribunal under the IBC remain stuck there, including that of the high-profile Essar Steel, as a result of its operational creditors seeking equal treatment. With the Supreme Court now ruling that there are “intelligible differentia” between operational and financial creditors, an avenue that defaulters used to stymie( stalemate) proceedings has been closed. Repayment of financial debt by borrowers infuses capital into the economy as lenders can on-lend the money that has been repaid to other entrepreneurs, thus aiding economic activity, the judges observed. The apex court has also clarified that a mere relationship with an ineligible person cannot disqualify someone from becoming a bidder for a troubled asset. It has to be proved that such a person is “connected” with the business activity of the resolution applicant. The court used strong words: “…[T]he experiment conducted in enacting the Code is proving to be largely successful. The defaulter’s paradise is lost.” This constitutes a clear signal of its backing for the IBC which, despite all the challenges that it has faced, has been successful in sending a message to recalcitrant(अड़ियल) defaulters that there can be no more business-as-usual when they default.

The saga of the Chinese scientist who created the world’s first gene-edited babies last November has forced researchers everywhere to take a hard look at the ethics of gene-editing. Chinese authorities have since condemned the researcher, He Jiankui, with a government report this week saying he violated both ethics and laws. But though Mr. He’s actions drew international outrage, they weren’t revolutionary in technological terms. Editing DNA to correct disease mutations has been possible for a while now, which means others can also do what Mr. He did. The promises of such gene-editing are boundless; over a dozen clinical trials are currently on to treat diseases like HIV, multiple myeloma and other forms of cancer, using the Crispr-Cas9 editing system. But none of them involve editing the so-called human germ-line; instead, they have restricted themselves to fixing genetic flaws in sick adults. In contrast, Mr. He deactivated a gene in two human embryos, which means that the changes he made could be inherited by the next generation. In doing so, he violated the widely held ethical consensus that it is too early for germline editing, for we simply don’t know enough yet about the risks of such fiddling.
One pitfall of embryo gene-editing is that it is not as precise as we need it to be today. Studies have shown that the technology can result in unintended mutations, which in turn can cause cancers. Then there is the danger of mosaicism, in which some cells inherit the target mutation, while others don’t. To be sure, the error-rates of Crispr are falling with each passing year. But we aren’t in the clear yet. What is more, even when gene-editing becomes fool-proof, the decision to edit embryos will still be a weighty one. This is because, today, scientists are far from understanding how exactly individual genes influence phenotypes, or the visible traits of people. Every gene likely influences multiple traits, depending on the environment it interacts with. This makes it hard to predict the ultimate outcome of an embryo-editing exercise without decades of follow-up. This uncertainty became evident in Mr. He’s experiment, in which he sought to immunise a pair of twins from HIV by tinkering with a gene called CCR5. The problem is that while protecting against HIV, a deactivated CCR5 gene can also make people more susceptible to West-Nile Fever. Every gene influences such trade-offs, which scientists barely understand today. This is why several scientific societies have advised abundant caution while fiddling with the human germline. In a 2017 report, the U.S.’s National Academies of Sciences, Engineering, and Medicine said such an intervention would be defensible only in very rare situations, where no alternative exists. The He Jiankui incident shows it is time to translate these advisories into regulations. Unless this happens, the Crispr revolution could well go awry.

परमाणु शस्त्र सबसे पहले प्रयोग न करने की नीति

अपने पिछले स्तंभ में मैंने यह दलील दी थी कि अब जबकि भारत ने भूमि, वायु, समुद्र और समुद्र की सतह के नीचे भी प्रतिरोधात्मक परमाणु हमले की क्षमता हासिल कर ली है तो उसे अपनी नाभिकीय नीति को लेकर एक नया रुख अपनाना चाहिए। मैंने कहा था, ' प्रतिरोध क्षमता की त्रयी पूरी करने के बाद अब आवश्यकता इस बात की है कि भारत की परमाणु हथियार संबंधी नीति की समीक्षा की जाए। अब जबकि हम विश्वसनीय दूसरी प्रहार क्षमता हासिल करने की स्थिति में हैं, ऐसे में हमारा ध्यान अंतरराष्ट्रीय परमाणु हथियार नियंत्रण व्यवस्था को लेकर चर्चा के बजाय एक ऐसी विश्व व्यवस्था कायम करने पर होना चाहिए जहां व्यापक संहार वाले इन हथियारों का इस्तेमाल न किया जाए।'

मैंने इसके आगे यह हिमायत भी की थी कि भारत चीन तथा अन्य परमाणु क्षमता संपन्न देशों के साथ मिलकर परमाणु हथियारों का पहले इस्तेमाल न करने की नीति पर आगे बढ़े जहां दुनिया के सभी प्रमुख परमाणु क्षमता संपन्न देश यह घोषणा करें कि वे पहले हमला नहीं करेंगे। यह काम आसान नहीं है। जाहिर सी बात है केवल पहले इस्तेमाल न करने की बात ही परमाणु युद्घ न छिडऩे के लिए पर्याप्त नहीं है। परंतु इन सब बातों के बावजूद यही एकमात्र उपाय है जिसकी सहायता से चाही या अनचाही परमाणु त्रासदी को रोका जा सकता है।

भारत संभवत: एकमात्र ऐसा परमाणु क्षमता संपन्न देश है जो इस दिशा में पहल को आगे बढ़ा सकता है। ऐसा इसलिए क्योंकि भारत स्वयं पहले परमाणु हथियार न इस्तेमाल करने की नीति का समर्थक है। अगर इसे लेकर हमारी प्रतिबद्घता कमजोर पड़ती है तो विश्व स्तर पर इसका अगुआ बनने की हमारी क्षमता पर भी नकारात्मक असर होगा। यही वजह है कि पिछले दिनों मैंने हिंदुस्तान टाइम्स में प्रकाशित कुणाल सिंह के लेख को बहुत सावधानीपूर्वक पढ़ा। अत्यंत तार्किक ढंग से लिखे गए उस लेख में देश के पहले हथियार इस्तेमाल न करने के सिद्घांत को लेकर नए ढंग से बातें कही गई थीं।

सिंह देश के पहले परमाणु हथियार इस्तेमाल न करने की नीति की समीक्षा की तीन वजह बताते हैं। पहली, भारत को चीन की बढ़ती श्रेष्ठता से निपटने के लिए परमाणु हथियारों पर भरोसा करना होगा। दूसरा, पाकिस्तान द्वारा परमाणु हथियार क्षमता हासिल करने के बाद भारत के लिए यह जरूरी है कि वह उनका इस्तेमाल रोकने के लिए अपनी ताकत का प्रदर्शन करे। तीसरा, भारत के पास तकनीकी पहुंच है जो उसके लिए हमलावर रुख को आसान बनाती है। 15 साल पहले हालात ऐसे नहीं थे जबकि यह सिद्घांत उस समय गढ़ा गया था।

जरा इनमें से हर दलील का परीक्षण करते हैं। पहली बात, चीन की पारंपरिक सैन्य बढ़त हकीकत है लेकिन इसका मुकाबला बिना परमाणु सिद्घांत को बदले भी किया जा सकता है। ऐसा भी नहीं है कि चीन की सारी सेना और उसकी सारी सैन्य शक्ति हमारे खिलाफ होगी क्योंकि उसके कई अन्य मजबूत शत्रु भी हैं। इसका एक अर्थ यह भी है कि हमें चीन के शत्रुओं के साथ तालमेल बनाकर यह सुनिश्चित करना चाहिए कि वह तमाम अन्य जगहों पर भी जूझता रहे। इसका एक अर्थ यह भी है कि हमें अपनी सेना के आधुनिकीकरण के काम को गंभीरता से लेना होगा। निष्क्रिय खरीद तंत्र को ठीक करना और बढ़ते राजकोषीय व्यय को कम करना हमारी शीर्ष प्राथमिकता होनी चाहिए।

मेरे नजरिये में हम चीन की सैन्य तैयारियों से ऐसे तरीके से भी निपट सकते हैं। इसके अलावा अगर मैं थोड़ी छूट लूं तो कह सकता हूं कि चीन के रणनीतिकार हमारी पहले परमाणु हथियार इस्तेमाल न करने की घोषणा पर यकीन ही नहीं करते। इससे पहले परमाणु सिद्घांत को लेकर एक स्तंभ में मैंने कहा था कि पहले परमाणु हथियार इस्तेमाल न करने की किसी पक्ष की घोषणा का यह अर्थ नहीं है कि उसका प्रतिद्वंद्वी भी चौंकाने वाला ऐसा हमला नहीं करेगा। किसी परमाणु हमले की स्थिति में जिस देश को यह हमला झेलना पड़ेगा उसे अभूतपूर्व नुकसान होगा। शायद यही वह डर है जो किसी देश को इन हथियारों का पहले इस्तेमाल करने से रोक सकता है। परमाणु प्रतिरोध का सार तत्त्व यही है।

दूसरी बात, क्या हमें पाकिस्तान की परमाणु हथियार इस्तेमाल में लाने की तैयारी की बहुप्रचारित बात का जवाब पहले हमले की तैयारी के साथ करना चाहिए? यह मानने की कोई वजह नहीं है कि पाकिस्तान का सैन्य-जिहादी गठजोड़ भारत की ऐसी किसी पहल के बाद सीमा पार आतंकवाद का इस्तेमाल करने से दूरी बनाएगा। बल्कि अगर ऐसा हुआ तो आतंकवाद कहीं अधिक उपयोगी साबित होगा। अगर आतंकवादी हमले और परमाणु हमले के बीच का अंतराल कम होता है तो पाकिस्तानी सैन्य प्रतिष्ठान के लिए हमें ब्लैकमेल करना कहीं अधिक आसान हो जाएगा और यह बाकी दुनिया के लिए भी परेशान करने वाली बात होगी। ऐसी कोई परिस्थिति तैयार करने से बेहतर होगा कि हम अपनी मौजूदा स्थिति पर ही टिके रहें: यानी परमाणु हमले का व्यापक प्रतिरोध किया जाएगा। इस बात से कोई फर्क नहीं पड़ता कि पाकिस्तान अपने हथियारों को सामरिक कहता है या युद्घक, वह अगर उन्हें हमारे क्षेत्र में या हमारी सेना के खिलाफ इस्तेमाल करता है तो उसे इसका भीषण प्रतिरोध का सामना करना होगा।

तीसरी बात, नई तकनीक की उपलब्धता और देश के हथियार जखीरे का आधुनिकीकरण होने से सिद्घांत में बदलाव की कोई आवश्यकता उत्पन्न नहीं होती। पहले इस्तेमाल के हिमायतियों को यह पता है कि पहले इस्तेमाल करने की क्या लागत आ सकती है। उसके लिए कमांड और नियंत्रण का बुनियादी ढांचा विकसित करने और उसका प्रबंधन करने में काफी धन राशि की आवश्यकता हो सकती है। परंतु अभी भी इस बात को लेकर कुछ ही लोग चिंतित हैं कि इससे हथियारों की होड़ उत्पन्न होगी। इस बीच राष्ट्रीय सुरक्षा बल्कि धरती की सुरक्षा को भी आनुपातिक रूप से जोखिम होगा। शीतयुद्घ के दौरान की अमेरिकी और सोवियत परमाणु नीति हमें यह चेतावनी देने के लिए पर्याप्त है कि आगे चलकर हम ऐसी परिस्थिति में पहुंच जाएंगे जहां परमाणु हथियार तो प्रचुर मात्रा में होंगे जबकि सुरक्षा कम से कमतर होती जाएगी। इसमें दो राय नहीं कि देश की सरकार को अपनी परमाणु हथियार नीति की नियमित और आधिकारिक समीक्षा करनी चाहिए। पहले परमाणु हथियार इस्तेमाल न करने की नीति को जारी रखने या उसे खारिज करने को लेकर अकादमिक बहस होती रहनी चाहिए। ऐसा करना अत्यंत महत्त्वपूर्ण है। फिलहाल किसी बड़े बदलाव की आवश्यकता नहीं है। इसके विपरीत यह बात काफी हद तक देश के हित में है कि हम ऐसी कूटनीति में निवेश करें जहां परमाणु हथियारों की प्रमुखता कम से कमतर होती जाए।

The multi-month low retail and wholesale inflation prints for December pose an interesting challenge for policymakers and the central bank. Inflation in Consumer Price Index (CPI), at 2.19% in December, is at an 18-month low, while the WPI, at 3.8%, is at an eight-month low. The Reserve Bank appears to have been blindsided by the CPI number, which is way below projections made during its last few monetary policy pronouncements. The RBI has maintained a CPI projection of 4.4-4.8% for the second half of fiscal 2019. Even in the October policy announcement, the bank projected 3.8-4.5% retail inflation in the second half with upside risk, and even changed its policy stance to “calibrated tightening” from “neutral”. The MPC and the RBI may well want to reassess the robustness of their inflation projection mechanism in light of the data coming in. When the new Governor, Shaktikanta Das, sits down with the monetary policy committee (MPC) in early February he may well have to return to a “neutral” stance given the soft trends in headline CPI. There may even be pressure on him to look at a rate cut, especially given the weak economic data coming in — factory output growth was a low 0.5% in November with manufacturing showing a contraction. The automobile industry, the first to feel the effect of an economic slowdown, has seen sales falling over the last two months.
The inflation data have also thrown a curveball at policymakers in that their different components show divergent trends. So, while headline CPI inflation is trending lower, core inflation is still sticky at close to 6%. Again, there is a divergence between core rural and urban inflation — the former is trending higher at 6.34% while the latter is heading downward at 5.26% in December. Curiously, rural health and education index numbers are high. The point with all this divergence in data is that monetary policymaking is a challenge. Governor Das alluded to this in a recent speech where he pointed to the divergences and volatility in different sub-groups as a major challenge in inflation assessment and projection. But the broader question is whether the interest rate structure is lagging behind the big structural change in inflation in the last few years. According to Mr. Das, headline CPI inflation has moderated from around 10% in 2012-13 to 3.6% in 2017-18 and 3.7% in April-December this fiscal. Yet the nominal interest rate structure has not changed significantly, leading to rather high real interest rates. Prominent policymakers, including principal economic adviser Sanjeev Sanyal, have called for the RBI to take a re-look at the interest rate structure. It will be interesting to watch how the RBI under the new Governor reacts to these calls.

दुनिया के करीब 29 फीसदी मुख्य कार्याधिकारियों (सीईओ) का मानना है कि 2018 के मुकाबले 2019 में वृद्धि की रफ्तार धीमी होगी। प्राइसवॉटरहाउस कूपर्स (पीडब्ल्यूसी) के वैश्विक सीईओ के एक सर्वेक्षण में यह बात सामने आई है। इन सीईओ का मानना है कि 2012 के बाद सबसे धीमी वृद्धि होगी। वर्ष 2018 में 48 फीसदी सीईओ ने मंदी के आसार जताए थे। धीमी वृद्धि के आसार सभी क्षेत्रों में हैं लेकिन उत्तरी अमेरिका और पश्चिमी यूरोप के सीईओ में सबसे ज्यादा निराशाजनक स्थिति है।

हालांकि करीब 42 फीसदी सीईओ का मानना है कि 2019 में वृद्धि में सुधार हो सकता है लेकिन यह 2018 के 57 फीसदी के मुकाबले काफी कम होगा। विश्व बैंक के आंकड़ों के मुताबिक वैश्विक सकल घरेलू उत्पाद (जीडीपी) ने वर्ष 2011 से ही 4 फीसदी के आंकड़े को पार नहीं किया है। वर्ष 2008-09 की आर्थिक मंदी के बाद से ही मध्यम अवधि (तीन वर्ष) में वृद्धि का भरोसा स्तर सबसे निचले स्तर पर चला गया है। वैश्विक स्तर पर महज 36 फीसदी सीईओ ही अगले तीन सालों में अच्छी वृद्धि की संभावनाओं को लेकर ज्यादा आश्वस्त हैं जबकि 2009 में 34 फीसदी सीईओ को ऐसा भरोसा था। इसका असर भारत पर भी पड़ सकता है क्योंकि भारत में निवेश पर बेहतर रिटर्न मिलने की उम्मीद करने वाले सीईओ की तादाद कम है जबकि 2019 में कहां निवेश किया जाए इसको लेकर अनिश्चितता की स्थिति में रहने वाले सीईओ की तादाद ज्यादा है।

पीडब्ल्यूसी ने 90 से अधिक देशों में सितंबर-अक्टूबर 2018 के दौरान 1,378 वैश्विक सीईओ का सालाना सर्वे किया। इस सर्वे को दावोस में विश्व आर्थिक मंच में सोमवार को पेश किया गया। एशिया प्रशांत क्षेत्र में जहां भारत, चीन और जापान जैसे देश हैं वहां वृद्धि की राह में तीन सबसे बड़ा खतरा 'व्यापार युद्ध', 'प्रमुख कौशल की उपलब्धता' और 'संरक्षणवाद' है। उत्तरी अमेरिका के करीब 31 फीसदी सीईओ का मानना है कि शिक्षा और रोजगार के बीच में सीधी कड़ी तैयार करना अहम है। एशिया-प्रशांत क्षेत्र में महज 11 फीसदी सीईओ ही इस तरह सोचते हैं।

उत्तरी अमेरिका में 31 फीसदी सीईओ कौशल विकास और दोबारा प्रशिक्षण देने को अहमियत देते हैं जबकि एशिया-प्रशांत क्षेत्र के 50 फीसदी सीईओ इसे तवज्जो देते हैं। वर्ष 2018 में नीतिगत अनिश्चितता को कोई गंभीर खतरा नहीं बताया गया लेकिन 35 फीसदी सीईओ का मानना है कि इससे 2019 में वृद्धि बुरी तरह प्रभावित होगी। 2019 के सर्वे में पहली बार 'व्यापार युद्ध' के असर के बारे में भी पूछा गया था और 31 फीसदी वैश्विक सीईओ को उम्मीद थी कि इससे आने वाले साल में वृद्धि दर कम होगी।

चीन की वृद्धि के लिए अमेरिकी बाजार की अहमियत 2019 में कम होगी क्योंकि चीन के21 फीसदी सीईओ का मानना है कि ऑस्ट्रेलिया 2019 में उनकी वृद्धि के लिए अहम होगा जबकि 17 फीसदी सीईओ का मानना है कि अमेरिका उनके लिए अहम होगा। वर्ष 2017-18 में 58 फीसदी सीईओ ने चीन की वृद्धि में योगदान देने वाले देशों में अमेरिका को शीर्ष स्थान दिया।

" Clear the air: on Rafale deal" the hindu editorial 21st January

That troubling questions about the purchasing of 36 Rafale fighter jets will persist despite a clean chit of sorts from the Supreme Court, was demonstrated compellingly last week following The Hindu’s detailed investigation into the deal. It showed that in comparison to the bid under the UPA there was an overall escalation in the price of each jet in the 2016 deal struck by the Modi government, because the price of 13 India Specific Enhancements (ISEs), essentially upgrades that were sought on the bare-bones aircraft, was spread over 36 jets as opposed to the original 126. Significantly, as The Hindu’s investigation revealed, three Defence Ministry officials in the seven-member Indian Negotiating Team objected to the €1.3 billion assigned to ISEs; it was eventually approved by a narrow 4-3 majority on the ground that ISEs are a non-recurring cost. But this raises an obvious and perplexing question: since they are a non-recurring cost, why did the government drop, or fail to secure, the follow-on provision, which would have given India the option to purchase more Rafales, and reduce the per-aircraft price by spreading the design and development costs involved in the upgrades? After all, the follow-on clause was a part of the deal under negotiation under the UPA government. The import of the question assumes an altogether different dimension given that the Air Force, with an old and depleting fleet, has required — and for some two decades now — far greater numbers of Medium Multi-Role Combat Aircraft (MMRCA) like the Rafale. Last year, the government issued a Request for Information for 110 fighters, of which about 15% will be acquired in a flyaway condition and the remainder manufactured under the strategic partnership route. With the same manufacturers back in the bidding fray, we are in a way back to where we were — in other words, to a place that casts doubts on the vigour of India’s long-term planning when it comes to defence preparedness.
Owing to a mix of investigation, statements and government leaks, much of the information about the pricing, the acquisition process and the ISEs are already in the public domain. It is nobody’s case that information that could impact the aircraft’s operational capability or jeopardise national security should be shared, but the government has been less than willing to come forward to address the issue of pricing. Instead it has been taking cover, unconvincingly, under the secrecy clause in the general security agreement signed between India and France in 2008. Given the fog of doubt over a number of issues, it is unclear why it doesn’t adopt a more accommodating posture by arranging private briefings for Opposition leaders and permitting a JPC to examine the deal. Without this, the general presumption will be that it has something to hide.

लोकपाल पर सुप्रीम कोर्ट सख्त, सर्च कमेटी को दिया नामों का पैनल तैयार करने का निर्देश

लोकपाल व्यवस्था के निर्माण में देरी को देखते हुए सुप्रीम कोर्ट ने भले ही संबंधित सर्च कमेटी को अपना काम पूरा करने यानी नामों का पैनल फरवरी के अंत तक तैयार करने का निर्देश दिया हो, लेकिन लगता नहीं कि हाल-फिलहाल लोकपाल का गठन होने वाला है। इससे संबंधित मामले की अगली सुनवाई अब मार्च में होगी। तब तक आम चुनावों की घोषणा हो सकती है। ऐसे में लगता नहीं कि नई सरकार के गठन के पहले देश को लोकपाल मिल पाएगा। यह एक विडंबना ही है कि जिस लोकपाल के लिए इतना बड़ा आंदोलन हुआ उसके प्रति अब कोई दिलचस्पी नहीं दिखाई जा रही है।

लोकपाल संबंधी कानून बने हुए चार वर्ष से अधिक बीत चुके हैैं, लेकिन अभी तक उसके गठन संबंधी कुछ बुनियादी काम ही नहीं हो सके हैैं। इस सबसे यही अधिक लगता है कि भ्रष्टाचार से लड़ने वाली इस व्यवस्था के निर्माण की जरूरत ही नहीं महसूस की जा रही है। यह समझ आता है कि केंद्र सरकार लोकपाल के गठन को लेकर बहुत उत्साहित नहीं, लेकिन केवल उसे ही दोष नहीं दिया जा सकता। लोकपाल के लिए नामों का पैनल तैयार करने का काम जिस सर्च कमेटी को सौंपा गया था वह भी सुस्त दिख रही है। इस कमेटी का गठन पिछले साल सितंबर में हो गया था, लेकिन अभी तक उसकी केवल एक बैठक ही हो सकी है।

सुप्रीम कोर्ट के निर्देश के बाद यदि यह कमेटी लोकपाल का हिस्सा बन सकने वाले नामों को पैनल तैयार भी कर लेती है तो फिर ये नाम चयन समिति के पास जाएंगे। यह चयन समिति जब तक अपना काम करेगी तब तक शायद देश में चुनाव हो रहे हों। क्या यह उचित होगा कि लोकपाल और उसके सहयोगियों के नाम तय करने का काम चुनाव के मुहाने पर खड़ी सरकार में शामिल लोग करें? इस सवाल का जवाब जो भी हो, यह किसी से छिपा नहीं कि लोकपाल संबंधी चयन समिति की बैठकें इसलिए भी बाधित हुईं, क्योंकि लोकसभा में सबसे बड़े दल के नेता के तौर पर कांग्रेस के सांसद मल्लिकार्जुन खड़गे उसका हिस्सा बनने के लिए तैयार नहीं हुए।

समस्या केवल यह नहीं है कि लोकपाल के गठन का काम प्राथमिकता में नहीं दिख रहा है, बल्कि यह भी है कि राज्य सरकारें लोकपाल की तर्ज पर लोकायुक्त के गठन में भी दिलचस्पी नहीं दिखा रही हैैं। एक समस्या यह भी है कि कुछ लोग अपने मन मुताबिक लोकपाल व्यवस्था का निर्माण होते देखना चाहते हैैं। यह अच्छा हुआ कि सुप्रीम कोर्ट ने ऐसे लोगों को झिड़का। पता नहीं लोकपाल का गठन कब होगा, लेकिन यह ठीक नहीं कि राज्य सरकारें लोकायुक्त को लेकर ढिलाई बरतें। वे इससे अनजान नहीं हो सकतीं कि आम आदमी रोजमर्रा के भ्रष्टाचार से अभी भी त्रस्त है।

माना कि केंद्र सरकार उच्च स्तर के भ्रष्टाचार पर लगाम लगाने में एक बड़ी हद तक कामयाब रही है, लेकिन राज्यों के स्तर पर नौकरशाही के भ्रष्टाचार में कोई उल्लेखनीय लगाम लगती नहीं दिखी है। ध्यान रहे कि आम आदमी को सबसे ज्यादा परेशानी राज्यों की नौकरशाही के भ्रष्ट तौर-तरीकों से ही उठानी पड़ती है।
